Terms of Service

These Terms of Service ("Terms") apply to Reserve A Rental ("we", "us") — our website https://reservearental.com and the Host websites we operate on its subdomains. By using the site, creating an account or making a booking, you agree to these Terms and to our Privacy Policy.

1. What we do

Reserve A Rental provides website, booking and marketing software to owners and managers of vacation rentals ("Hosts"). The Host — not Reserve A Rental — offers each rental, sets its prices, house rules and cancellation policy, and is responsible for the stay. When you book, your rental agreement is with the Host. We are not a party to it, a real-estate broker, or an insurer.

2. Bookings and payments (guests)

• You must be at least 18 years old to book, and the information you provide must be accurate.
• The total price, including any cleaning or service fee, is shown before you pay. Payments are processed securely by Stripe.
• A booking is confirmed only after payment succeeds and you see a confirmation page or receive a confirmation.
• Cancellations and refunds follow the cancellation policy shown on the listing. Contact the Host to cancel or change a booking.
• You agree to follow the Host's house rules and occupancy limits, and you are responsible for damage caused during your stay as set out by the Host.
• Calendars are synced with other booking sites but can occasionally be out of date. If a double booking happens, the Host will contact you and refund any payment for dates that cannot be honoured.

3. Host accounts

If you create a Host website, you agree that:

• Your account details, listings, photos, prices and descriptions are accurate and that you have the right to rent the properties listed.
• You are responsible for complying with all laws that apply to your rentals, including licences or permits, occupancy and safety rules, taxes (including lodging taxes), accessibility and fair-housing laws.
• You own your content and give us a licence to host, display, adapt and promote it in order to provide the service, including in search engines and listing feeds.
• You are responsible for the guest relationship, including honouring confirmed bookings, refunds and handling guest data in line with our Privacy Policy and applicable law.
• Marketing emails you send through the service go only to guests who opted in, and you provide a valid postal address for them.
• Your site goes live only after our review, and we may decline, suspend or remove sites or content that break these Terms.
• Fees for our plans are described on our pricing page or in your order, and are due as stated there.

4. Acceptable use

Do not use the service to post false, misleading or unlawful listings; infringe anyone's rights; send spam; collect other users' data; interfere with the service's security or operation; or attempt to access accounts or data that are not yours.

5. Our content

The software, design and our own content belong to Reserve A Rental or its licensors. You may use the site only as these Terms allow.

6. Disclaimers

The service is provided "as is" and "as available". We do not own, inspect or manage any rental and make no promises about a property, a Host or a guest. Listing information comes from Hosts. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

7. Limitation of liability

To the fullest extent the law allows, Reserve A Rental is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim (not including amounts paid to Hosts) or US $100. Some places do not allow these limits, so they may not apply to you.

8. Indemnity

If you use the service as a Host, you agree to defend and indemnify Reserve A Rental against claims arising from your listings, your rentals or your breach of these Terms or the law.

9. Ending your use

You may stop using the service at any time. We may suspend or end access if these Terms are broken or if needed to protect users or the service. Sections that by their nature should survive (for example, disclaimers and limits of liability) continue to apply.

10. Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Wisconsin, unless the law where you live requires otherwise.

11. Changes

We may update these Terms. The date at the top shows the latest version. If you keep using the service after changes take effect, you accept the updated Terms.
